The present General Terms and Conditions of Sale define the terms for subscribing, billing, and commercial use of Autoya services. They govern the contractual relationship between The Next Stories SAS and its professional clients, in order to ensure a reliable collaboration, in accordance with industry practices and legal requirements.

Using Autoya services or subscribing to a subscription constitutes full and complete acceptance of these conditions.

1. Scope

The present General Terms and Conditions of Sale (hereinafter referred to as the "GTC") govern all sales of services offered under the brand Autoya, a software solution published and operated by The Next Stories SAS.

They apply to any professional client, whether a legal entity or individual acting in the context of their activity, using or subscribing to Autoya services.

Any use of Autoya or subscription to a service implies the unconditional acceptance of these GTC.

Autoya is a registered trademark and a marketed product by The Next Stories SAS.

3. Description of Services

Autoya is a SaaS solution dedicated to creating automotive visuals, including:

  • the cutout and optimization of vehicle photographs;

  • the generation of backgrounds and visuals assisted by artificial intelligence;

  • the hosting and management of visual content;

  • the export and professional use of generated visuals.

The services are provided as-is, based on the features available at the time of subscription.

4. Subscriptions and Commitment

4.1 Duration of Commitment

Unless otherwise stated in a specific offer or a signed quote, Autoya subscriptions are concluded for a firm duration of twelve (12) months.

At the end of the initial period, the subscription is automatically renewed for successive periods of twelve (12) months.

4.2 Information Before Renewal

In accordance with good commercial practices, The Next Stories will inform the Client of the upcoming renewal of their subscription before the deadline, by email or notification.

4.3 Termination

Termination must be notified in writing (email or client area) at least three (3) months before the annual expiration date.

Failing that, the subscription is automatically renewed.

5. Pricing and Financial Conditions

Prices are indicated in euros excluding taxes (HT).

They may be:

  • displayed online on the Autoya site;

  • defined contractually in a quote or order form.

The Next Stories reserves the right to modify its prices, with no retroactive effect on ongoing subscriptions.

6. Billing and Payment

Billing is done according to the agreed periodicity (monthly or annually).

Payments are due upon receipt of invoice and can be made via:

  • credit card;

  • bank transfer (depending on the offers).

Any delay in payment will automatically result in:

  • the application of legal late penalties;

  • a flat fee of €40 for collection costs.

7. Credit System and Consumption

Autoya subscriptions include a volume of credits corresponding to the use of services.

The credits:

  • are consumed according to the usages performed;

  • are neither transferable nor refundable;

  • expire at the end of the contractual period, unless otherwise stipulated.

No claim may be based on total or partial non-consumption of credits.

8. Obligations of the Client

The Client commits to:

  • use Autoya in accordance with its professional purpose;

  • provide lawful and compliant content with regulations;

  • respect the right to image and the rights of third parties;

  • not circumvent or attempt to circumvent technical limitations.

The Client remains solely responsible for the visuals used in the context of their commercial activity.

9. Responsibility – Specific Limits in the Automotive Sector

Autoya provides a visual processing and generation tool.

The Next Stories:

  • does not guarantee the commercial performance of the ads;

  • is not involved in the dissemination of visuals;

  • is not responsible for marketing or business decisions made by the Client.

Results may vary depending on the quality of source photos, shooting conditions, and actual uses.

10. Suspension – Early Termination

The Next Stories reserves the right to suspend or terminate access to the service, without compensation, in the event of:

  • non-compliance with the T&Cs or GTC;

  • non-payment;

  • fraudulent or illegal use;

  • harm to the image or security of the service.

Amounts already billed remain due.

11. Evolution of the General Terms and Conditions of Sale

The Next Stories reserves the right to modify these General Terms and Conditions at any time.

The new General Terms and Conditions apply:

  • to new subscriptions;

  • to renewals;

  • and, after prior notification, to ongoing subscriptions.

Continued use of the service constitutes acceptance of the updated General Terms and Conditions.

12. Acceptance of the General Terms and Conditions

The Client acknowledges that :

  • the subscription to Autoya;

  • the activation of an account;

  • or the effective use of the service

constitute full and complete acceptance of these General Terms and Conditions of Sale.

13. Governing Law and Jurisdiction

The present General Terms and Conditions are governed by French law.

Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts of Nantes.
